     Terms and Conditions of Auction

 

Any person participating in the auction shall be bound by the following terms and conditions subject to amendments and/or modifications announced at the time of the auction.

 

All persons desiring to bid must be registered and have obtained a Bidder’s number.  Valid Picture ID is required at buyer check-in. 

We reserve the right to refuse anyone the privilege of bidding or attending the auction and may revoke such privilege at any time.

 

All items are sold as-is, where is, with no warranty expressed or implied.  All sales are final.  It is the responsibility of each prospective bidder to fully inspect each lot prior to bidding.  We reserve the right to add or delete items from the auction and to sell items by individual group lots or to subdivide lots as deemed appropriate. 

 

The auctioneer reserves the right to sell subject to reserve or open the bidding at a pre-determined amount appropriate with the value of the item.  The auctioneer reserves the right to sell and purchase for its own account, on behalf of third parties and/or for the account of others, whether by verbal or written proxy.  All items are subject to prior sale.  We reserve the right to correct any mistakes or typographical errors made by our behalf in any of our announcements or documents, without the liability of deriving right from the corrected announcements. 

 

The final sale price and successful buyer’s number will be announced upon the sale of each lot.  All questions and/or disputes must be resolved immediately upon the sale of each lot.  No changes will be made at any later time and the sales record kept by the Auctioneer and/or sales clerk will be taken as final in the event of any dispute.

 

All purchases must be paid in full immediately upon the completion of the auction.  Accepted forms of payment include cash, approved check, MasterCard, Visa, and American Express.  All checks are subject to our approval.  We reserve the right to hold purchases until a check clears.  A $25.00 Returned Check fee will be charged on any returned check.  A buyer’s premium may or may not be charged on all items.  Any buyer’s premium charged will be posted the day of the auction.  Payment made by Check will include an additional 2% buyer's premium.  Payment made by Visa, MasterCard, or Discover will include an additional 3% buyer’s premium.  Payment made by American Express will include an additional 4% buyer’s premium.  Any purchases not paid for and removed within the specified time period may be resold without notice.

 

North Carolina State and Mecklenburg County Sales Tax will be collected unless a valid Resale Tax Certificate is on file or item is shipped out of state and purchaser pays shipping, handling, and insurance charges.

 

Absentee bidding is available.  All absentee bids must be secured with a valid credit card number or a 50% cash deposit.  Arrangements for bidding should be made as early as possible.  All absentee bids are accepted as legal and binding contracts to purchase the described items.  In the event of a tie high bid, the live bidders high bid will supersede any absentee bids.  Payment for absentee bids is required within one business day after the auction date.  Payment may be made in person or by phone.  We assume no responsibility for failure to execute any bid(s) for Absentee bidding or when Internet or real-time Internet bidding is utilized.  If purchaser is not able to pick item(s) up in person, all shipping, insurance, and handling charges are the sole responsibility of the purchaser and must be paid in full before any item(s) is shipped. 

 

We reserve the right to make audio and video recordings of the auction and to use said recordings publicly if deemed appropriate.  Participants give their permission by participating in and attending the auction.

 

The auctioneer is acting as agent only and is not responsible for the acts of its principles.

 

All transactions shall be governed by and construed in accordance with the laws of the state of North Carolina, USA.  The venue for trial or resolution of any dispute arising out of or related to said transaction shall be in the North Carolina State Courts sitting in Mecklenburg County, North Carolina, USA.  If any provisions of these terms and conditions shall be held invalid, illegal, unenforceable or inoperative, the balance of the terms and conditions shall remain in full effect as if such provisions had been excluded.

 

Bidding on an item and/or participating in an auction indicate your understanding and acceptance of these terms and conditions.
